Easements

GMW is the beneficiary of easements on privately owned titles across Victoria. These easements have been created for the protection of GMW assets, GMW operations and/or responsibilities.

Easements on Title in favour of GMW

Easements which are for the protection of GMW assets, GMW operations and/or responsibilities are usually shown on title in favour of GMW, or one of GMW’s predecessors (some of which are listed below).

The costs and disbursements associated with easement matters which are not initiated by GMW must be paid for by the landowner/applicant.

Use of easements 

GMW has a continuing obligation to maintain any works it has constructed on land that is subject of an easement. This includes maintenance of GMW channels located within an easement.

Property owners of land subject to an easement cannot interfere with any works that GMW undertakes within the easement.

Under the Water Act 1989 (Vic), it is an offence to interfere with GMW’s works without authorisation.

Managing vermin and noxious weeds within easements

Customers are responsible for the control of vermin and noxious weeds located on water supply, delivery and drainage easements on their property.

Managing trees, vegetation and livestock within easements

Owners of land must not plant trees or other vegetation on water supply, drainage or carriageway easements on their property which could impact GMW’s works or GMW’s access to its works.

Landowners are responsible for ensuring stock do not damage assets owned by GMW, including assets within easements.

GMW can require a landowner to take the necessary steps to ensure that stock do not damage channel and drain banks such as erecting fences.

Fencing

Fencing along an easement is essential to safeguard GMW's asset located within the easement area and to ensure its continued functionality.

Landowners who have an easement on their property may be required to repair or replace damaged fencing as required by GMW.
